National Drug Authority licensing guidelines illegal- High court rules

The high court held at Kampala has ruled that the National Drug Authority (NDA) secretariat in developing licensing guidelines of 2017/2018 acted outside its legal mandate and usurped powers vested in the minister of health.

This follows a dispute and compliant that arose after Petnum pharmacy limited sued National Drug Authority challenging the NDA’s guideline on renewal of license for pharmacies

These guidelines provided that pharmacies in Kampala may locate within the same district  but must be at least 500 meters from the nearest pharmacy.

Justice Ssekaana ruled that NDA through actions of its employees was vicariously liable for the unauthorized act of enacting guidelines without authority or their involvement and they abdicated their responsibility of supervising their staff.
